When filing a MERS (Mortgage Electronic Registration Systems Inc.) mortgage, discharge of mortgage or assignment of mortgage you must list the original bank. When we index these instruments that have been recorded by MERS we index against MERS and all the names of the parties involved. This also means the bank for which MERS is nominee. Be sure the original mortgage book and page dates and dollar amount is on all discharges and assignments. On mortgages and deeds be sure all parties have addresses and the town is listed.

Policy relating to the Recording of Deeds
The document must be dated, signed, and properly notarized. All deeds must be recorded with the proper forms – RP5217 and TP584. A grantor who is not a resident of New York State must complete an IT2333 form. These forms must be completely filled out and signed. The recording fees must accompany the document. Policy relating to Discharge of Mortgage
When discharging a mortgage please make sure the names are correct along with the dates and book and page of the mortgage to be discharged. It has to be signed and properly notarized. If you have more than one mortgage listed on your discharge that needs to be satisfied, we charge for EACH mortgage to be marked. The fees are: $5.00 per page, a $45.00 cover page, $25.00 entry fee and a $.50 charge for any name over two on the instrument (mortgagor/mortgagee). This fee applies for EACH mortgage to be marked. We also appreciate a self-addressed stamped return envelope.
Policy relating to Overage
The Essex County Clerk has established a policy that allows the office to retain and account for any overages of $10.00 or less.
